Terms & Conditions for Soundworks Birmingham Ltd
Introduction
Soundworks Birmingham Ltd (referred to as “we”, “us”, or “Soundworks”) provides private music production Sessions and recording studio services to children and adults. These terms and conditions govern the relationship between Soundworks Birmingham Ltd and its customers (“you” or “the customer” or “the customer”). These Terms and Conditions apply to both in-person and virtual sessions.
Booking and Availability
Sessions are booked in advance based on availability. Sessions can be booked using our online booking system, via email or in person. Payment is required in advance of the first session only. A session is not confirmed until the customer receives the email confirmation from our booking system. Customers are required to complete and sign the ‘new starter form’ prior to their first session with us. We reserve the right to cancel or reschedule Sessions due to unforeseen circumstances.
Cover Sessions
Although the customer will have the same Teacher/Producer for 99% of the Sessions, a cover Teacher/Producer or producer maybe used, without prior notice, in the event of unplanned absence or sickness. The cover teacher/producer/producer will be aware of your current progress. In the event that cover can not be secured, the session will be cancelled, the customer will be advised, and no fees will be processed.
Notifications & Marketing
All customers must receive the standard appointment notifications in the form of email and text message reminders. Upon the sign-up process, customers can opt in/out of marketing messages. Our system restricts the sending/receiving of text message to within sociable hours.
Copyright and Song Share
Payment for studio time does not grant or remove any rights to songwriting, master recordings, or royalties, which must be agreed separately in writing between the parties involved. Royalties and song writing credits are based on creative contribution and ownership rights, and nothing to do with who pays for the studio time.
The customer/artist may be asked to read and sign a Session Agreement which details the creative contributions of all parties, studio fees, song and master ownership, and credits.
Cancellation Policy
Once a booking is confirmed, our 48-hour cancellation policy applies. A minimum of 48 hours is required to cancel or change your booking with us. The FULL SESSION fee will automatically be charged if you fail to show up for a session or if you cancel it (for any reason) inside 48 hours. If you are ill and cannot make the session booking, the session fee will still be charged unless we can rearrange the session for that same week, but this solely depends on producer/Teacher/Producer availability. Please do not attend Sessions if you are ill and there is a risk of transmission. Where possible, Soundworks will be as flexible and as accommodating as possible.
Lateness
If a customer does not attend the session by the time 50% of the session duration has lapsed, without any prior communication, the Teacher/Producer has the right to mark the appointment as a no show and leave the premises. This session will also be automatically charged. If you are running late for your appointment, please let us know where possible. If you arrive late for your session, the Teacher/Producer is under no obligation to extend the session time any longer than the original scheduled time, especially if they have other customers waiting. If the Teacher/Producer is running late, every effort will be made to communicate this with the customer prior to their arrival and the session will either be extended, or time added onto the next appointment.
Payment of Fees
Fees for the first session only are required in advance. ALL payments are handled on account via our autopay system, managed by Stripe. Sessions can be paid for individually or in discount packs (please see the pricelist for full payment options) A valid debit/credit card MUST be held on account with us. CASH is not accepted. Payments for late cancellations and no shows will automatically be charged. We will seek prior approval from you to process payments for other non-session items such as tickets, merchandise, exam fees etc. Once started, discount session packs are non-refundable. Discount session packs must be used within a six-month period.

Examinations, Competitions, and Performances

Customer Progress – Quality of finished product
Your Teacher/Producer will provide regular updates on you or your child’s progress. Using our free Practice Space app, you will have access to thorough session notes, content and practice targets set by your teacher/producer. A customer progress form is available and can be used periodically, to agree short and long term goals in writing between the Teacher/Producer and Customer. Taking Sessions alone is not a guarantee of progression. The customer accepts that progress can be determined by personal practise to support the learning as advised by the teacher/producer.
Termination of service
The session service can be terminated at any time by both Soundworks and the customer. If the Customer chooses to terminate the service, any remaining Sessions from a pre-paid discounted session pack are non-refundable. The Teacher/Producer reserves the right, and entirely at the Teacher/producer’s discretion, to refuse tuition with immediate effect by giving written notice of termination to the customer or the customers parent or carer in the event of a safety concern for themselves or the customer. If the Teacher/Producer chooses to terminate the session service, any outstanding fees will be refunded, unless in the case of a safety concern by the teacher/producer, in which case a full written notice will be provided. The Teacher/Producer reserves the right, entirely at the Teacher/producer’s discretion, to refuse tuition with immediate effect if the customer appears to be sick and there is a risk of transmission. Refunds will not be offered in this case. If a Teacher/Producer becomes sick and is worried about the risk of transmission, then their remaining Sessions for that day will either be cancelled, covered or converted to online sessions.
School Holidays and Inclement Weather
Progress is closed over the Christmas and New Year period but is open all year round otherwise and does not follow the school term times. In the event of an inclement weather cancellation, you will be notified of a studio closure. Sessions cancelled due to inclement weather will be held virtually or cancelled. Sessions cancelled late due to weather conditions are subject to the same cancellation policy as usual, unless Progress has decided to close entirely for that period. If you are worried about the weather affecting your appointment, please make sure you cancel with enough notice, or change to an online session.
